(KTDY) - Thanks to social media, dumpster diving, looking in a dumpster for valuables, has become a hobby for some, but can you legally take stuff out of a dumpster once it has been discarded?

Well, in Louisiana, dumpster diving is not specifically illegal, but it does depend on how and where you do it.

For some, when they see a dumpster with "Stuff" in it, they feel the urge to explore what has been thrown away, in hopes of finding something that they may need/want or something that may have value to it.

While dumpster diving may be legal in one jurisdiction, it may not be in another, and that is why you need to be aware of the laws where you may partake in the hobby.

Is It Legal to Take Garbage From a Dumpster on Private Property?

In Louisiana, you cannot legally take anything from a dumpster on private property. If a dumpster is on private property, behind a gate or fence, or has a "No Trespassing" sign on it, you can not legally enter it. If you do and are caught, you can be charged with trespassing.

According to LegalMatch. If you break a lock on a dumpster to enter it and are caught, you can be charged with criminal damage to property, and likewise, if you throw trash on the ground and leave it while digging, you may be charged with littering.

Can You Take Garbage From Containers on Public Grounds?

LegalMatch states that under state law, once trash is discarded and placed in public areas for collection, it can be considered abandoned property. State law does not recognize ownership over discarded items in public spaces.

Again, if you throw contents in the container on the ground, you are littering and can still find yourself in legal trouble.

Legal Consequences For Dumpster Diving

Even if dumpster diving is permitted in the area that you are in, you should proceed with caution. For example, if you are taking stuff from a business's dumpster and they consider what they have disposed of to have value, you can be charged with theft.

If found guilty of violating the dumpster law in a specific jurisdiction, you may be forced to pay a small fine or a larger fine, depending on what charges may be brought against you.
