Report Indicates Roe V Wade Will Be Overturned

The longstanding Supreme Court Ruling in Roe V Wade which opened the door for abortions could be overturned. In fact, the Politico reports the nation's high court has voted to overturn Roe V Wade. This would open the door for Louisiana lawmakers to pass laws banning all abortions in the Bayou State.

Congressman Mike Johnson posted this message on his Facebook page:‪

All of us are scrambling tonight to discern the facts, but if indeed this is a leak of a draft SCOTUS opinion—it is not only unprecedented, but also an apparent and shameless attempt to pressure the justices to reverse their correct position that individual states can outlaw the killing of unborn babies.‬

‪There is no constitutional right to an abortion, and there never has been.‬

‪Court, stand strong!

Pro Life Louisiana says:

If this happens, Louisiana is legislatively and constitutionally prepared to protect all unborn babies from abortion within the state. And if this happens, Louisiana is ready to support women, both before and after birth.

What Is Behind the Leak of this Opinion?

Is the leak of the opinion a political maneuver? Some say it might be. Others are calling for a full investigation into the leak and the offending party should be disciplined, if not prosecuted for a crime.

In this report, Justice Samuel Alito writes in the preliminary draft of the ruling:

Roe was egregiously wrong from the start. Its reasoning was exceptionally weak, and the decision has had damaging consequences. And far from bringing about a national settlement of the abortion issue, Roe and Casey have enflamed debate and deepened division.

Justice Alito adds: "We hold that Roe and Casey must be overruled."

Politico reports:

"The draft opinion is a full-throated, unflinching repudiation of the 1973 decision which guaranteed federal constitutional protections of abortion rights and a subsequent 1992 decision – Planned Parenthood v. Casey – that largely maintained the right. “Roe was egregiously wrong from the start,” Alito writes."

The report also says Alito writes:

We hold that Roe and Casey must be overruled, It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.

If this is an accurate report and Roe V Wade is being overturned, this would leave the decision about abortion up to the states.

Why is this leak so suspicious? Politico reports "no draft decision in the modern history of the court has been disclosed publicly while a case was still pending."
